It’s a common misconception that only the Crown or Statutory Prosecuting Authorities can use the criminal system to prosecute people or companies. We specialise in Private Criminal Prosecution (PCP), which are almost always quicker, more focussed and more efficient than public prosecutions, especially in cases involving fraud.
Criminal investigations and prosecutions that are handled by the Crown Prosecution Service (CPS) have two drawbacks for the victim:
1) You lose any influence in the strategy of the prosecution including costs and compensation. The CPS take control of evidential packages and effectively take ownership of the prosecution.
2) You will only ever realise a fraction of the compensation awarded, as other bodies are entitled to a large percentage of your money.
In contrast, the POC Private Criminal Prosecution model allows the victim organisation to retain control of the prosecution at all stages, resulting in a full end-to-end case management process.
This radical approach to criminal prosecutions is still in its infancy in the UK; however the approach was pioneered by the directors of POC Management. Our tailor-made service enables you to apply for costs and compensation that, if granted, is awarded to you and NOT any other body.
In certain circumstances the victim organization will need to pay for the services of an accredited LEA Financial Investigator, which could amount to 25% of the overall compensation order made, but this of course will still leave the victim with 75% of the remaining compensation and the majority of costs of bringing about the prosecution.
